WiFi / WLAN - Terms of Use
As part of the rental of the vacation property “Ferienwohnung Siegel”, the landlord makes his Internet connection available for use by the tenant. In Germany, a connection owner can be held liable for legal violations committed from his Internet connection. Nevertheless, the landlord makes his connection available to the tenant in reliance on his compliance with the law.
The tenant undertakes to comply with German law and the following rules:
General Terms of Use
1. the WLAN/WiFi access offered is password-protected and is only valid for the rental period of the stay.
1. a. The usage data may not be passed on to third parties.
1. b. The loss or disclosure of user data to third parties must be reported to the landlord immediately.
2. the actual and permanent availability or reliability of Internet access is not guaranteed.
3. the landlord reserves the right to revoke the access authorization in whole or in part at any time. In particular, access to certain services or websites may be blocked by the landlord at his discretion.
Disclaimer of the landlord
1. the use of WLAN/WiFi is at the tenant’s own risk.
2. the landlord expressly points out that malware can get onto the tenant’s device through Internet use.
3. the provision of Internet access does not include a firewall or virus protection – it is the tenant’s responsibility to protect their end device. Virus protection software is suitable for this purpose.
4. the data traffic originating from the WLAN connection provided is encrypted using WPA2. The landlord is not responsible for any further protection against misuse by third parties.
5. the landlord assumes no liability for damage to the tenant’s end devices caused by WLAN use. Excluded from this exclusion of liability is damage caused by gross negligence or intent on the part of the landlord or his agents. Responsibility of the tenant.
6. the tenant undertakes to comply with applicable law and not to use the WLAN access for the following purposes (this is not an exhaustive list)
◦ Distributing, making available or reproducing copyrighted material – in particular “file sharing”
◦ Sending harassing, threatening, defamatory, immoral or illegal content
◦ Sending SPAM (mass notifications)
7. if the tenant enters into chargeable legal transactions via the WLAN access, he is solely responsible for the liabilities entered into. The resulting costs shall be borne solely by the tenant. Indemnification of the landlord from third-party claims.
8. the tenant indemnifies the landlord against all claims and damages of third parties which are due to an illegal use of the Internet access or a violation of the agreed rules by the tenant.
9. all costs and expenses incurred in defending against or asserting claims and damages of third parties are included in the indemnification.
The lessee hereby confirms that he has been informed of the existing rules and that he will comply with German law. This contract comes into force upon acceptance of the terms of use for WLAN guest access.
